These terms apply to all visitors to statesvilledeckandfence.com, all customers who request estimates, and all customers who enter into a service agreement with Statesville Deck & Fence.
Statesville Deck & Fence provides residential outdoor construction services including deck building, fence installation, pergola construction, and related work in Statesville, NC and surrounding areas. Services are performed by appointment following an in-person estimate.
Information on this website is provided for general reference only. Details about specific services, timelines, and pricing are finalized in a written estimate and project contract.
All estimates provided by Statesville Deck & Fence are written and itemized. An estimate is not a guarantee of final cost until both parties have signed a project contract. Estimates are typically valid for 30 days from the date of issuance unless otherwise noted.
Prices may be affected by changes in material costs, project scope changes requested by the customer, or conditions discovered during construction that were not visible or known at the time of estimating. Any change that affects the contract price will be communicated to the customer in writing before additional work is performed.
Submitting a contact form or requesting an estimate does not constitute a binding agreement and does not guarantee pricing or availability.
Project start dates are confirmed in writing after a contract is signed and any required deposit is received. Statesville Deck & Fence will make reasonable efforts to begin and complete work on the agreed schedule. Delays caused by weather, permitting timelines, material availability, or other factors outside our control do not constitute a breach of contract.
If you need to reschedule or cancel a project, please contact us as soon as possible at hi@statesvilledeckandfence.com or (980) 759-0506. Cancellation terms, including any deposit refund conditions, are specified in your project contract.
Statesville Deck & Fence reserves the right to cancel or reschedule work due to unsafe weather conditions, site access problems, or other circumstances that would prevent safe and quality work.
Payment terms are outlined in your project contract. In general, a deposit is required before work begins, with the remaining balance due upon project completion unless otherwise agreed in writing.
Accepted payment methods are specified in your contract. Invoices not paid by the due date may be subject to a late fee as stated in the contract. Statesville Deck & Fence reserves the right to pause or stop work on projects with outstanding unpaid balances.
Any disputes about an invoice must be raised in writing within 10 days of receipt. Payments made after that date are considered accepted.
Statesville Deck & Fence will apply for required building permits on behalf of the customer where this is included in the project contract. The customer is responsible for any permit fees unless otherwise agreed. Work will not begin until all required permits are approved.
Customers are responsible for disclosing any HOA rules, deed restrictions, or easements that may affect the project before work begins. Statesville Deck & Fence is not responsible for delays or costs resulting from undisclosed restrictions discovered after a contract is signed.
Statesville Deck & Fence stands behind the quality of its workmanship. Specific warranty terms for labor and materials are provided in your project contract and vary by project type and materials used.
This website and any general information provided through it are offered as-is, without warranty of any kind. We make reasonable efforts to keep information current and accurate, but we do not guarantee that every detail on this site is complete or error-free.
Manufacturer warranties on materials such as composite decking, vinyl fencing, or hardware are provided directly by the manufacturer and are subject to their terms.
To the fullest extent permitted by law, Statesville Deck & Fence will not be liable for indirect, incidental, or consequential damages arising from the use of this website or from services provided. Our liability for any claim related to a completed project is limited to the amount paid for that project.
Nothing in these terms limits our liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

If a dispute arises between you and Statesville Deck & Fence, both parties agree to first attempt to resolve it through good-faith negotiation. If direct negotiation does not resolve the matter, both parties agree to participate in non-binding mediation before pursuing any formal legal process.
Nothing in this section prevents either party from seeking emergency injunctive relief in court where necessary to prevent irreparable harm.
These terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any legal action arising from these terms or your use of this website will be brought in a court of competent jurisdiction in NC.
